Chapter 73
Ancient Kātyāyana SanskritRe-partition of Concealed Property
If concealed wealth is discovered again, the sons, in the absence of the father, should divide it equally among the brothers. // K_885 //
Property that was mutually concealed, and what was wrongly divided, if discovered later, should be divided in equal shares, says Bhṛgu. // K_886 //
Wealth that is acquired by a divided member belongs to him alone. What was stolen or lost and is recovered should be re-divided as stated before. // K_887 //
Property taken away by a kinsman should not be forcibly made to be returned. One should not make undivided kinsmen pay for their enjoyment (of common property). // K_888 //
He who, having abandoned the common field, has settled in another country—a share must be given to his descendant who has returned; there is no doubt. // K_889 //
Whether he be the third, fifth, or even the seventh in descent, if his birth and name are unknown, he shall receive his hereditary share. // K_890 //
He whom the hereditary residents and neighbors know by tradition to be the owner, the land must be given by his kinsmen to his descendant who has returned. // K_891 //
If those who were divided from the paternal estate live together again, they should re-divide. He from whom the gain arose shall receive a double share. // K_892 //
